How has the Internet changed the escort industry?

In the last 20 years, the Internet has changed our lives. It has given birth to new industries, revolutionized others, and placed others in the “endangered list”.  In its most basic form, the Internet allows information to be published to a global audience.  For example, our website in Panama has been visited from faraway places like Djibouti (a country in the Horn of Africa), RĂ©union (an island in the Indian Ocean), and Aland Islands (an archipielago in Finland).  Also, search engines like google and yahoo make finding information quick and easy.  For example, our website is among the first 20 results in google under the search “panama escorts”
Our industry has not escaped the Internet revolution.  Offering sexual services in exchange of money has always been a difficult profession.  There are not only health risks, but also security (Is this customer a robber or a murderer?) and social (What if my friends and family find out that I work in this?) concerns.  Although many of these risks cannot be eliminated regardless of technological advancement, the Internet has definitely changed the escort industry.
Historically, prostitution can be categorized in two forms: “outdoor” and “indoor”.  The outdoor prostitution features escorts in an outdoor setting.  The classic example is seen in the movies and television programs where the escort is standing in a street corner while the potential customer  drives around with his car, the car stops and a brief negotiation ensues before  the escort gets on the car and onto the action.  Indoor prostitution is where escorts are in indoor places.  These places could be massage parlors, hotels, private houses and apartments.  The customer arrives to the location and meets the escort.
The Internet has reduced advertising costs.

Like any business, escorts must advertise to attract customers.  Historically, this has been done by standing in a street corner or bar, placing a classified ad in the paper, or by word of mouth.  The drawback of these methods is that they have a limited reach. They also do not allow both parties (the customer and the escort) to exchange enough information about the wanted services on one side and offered services and their costs on the other. 
The Internet allows advertisers to reach a global audience.  It also allows the advertiser to convey much more information regarding prices and services offered than a brief conversation in a street corner or in a classified advertisement.  Those escorts offering specialized services are the ones that benefit the most from the Internet since it allows potential customers to find them by their specialties.
The Internet has also benefitted customers.  They can obtain more information beforehand regarding an escort and its services.  This allows a better match between the customer wants and the escort offered services.
The Internet has reduced security costs.

Escorts meet a great range of people in their profession.  Not all these people have the best intention.  In those countries where prostitution is illegal, escorts must avoid the authorities.  Therefore, security represents a significant cost.  This security cost goes from refusing unknown customers (which could be an undercover police officer or a dangerous customer) to hiring drivers and enforcers.  Also, some escorts band together in a group to share costs or joined agencies that provide such services.  In exchange, the escort gives a percentage of its fee to the agency.  This percentage can be significant and in some cases it could be half of the escort fee.
With the Internet, the escorts could verify by themselves their potential customer identity or references before meeting the customer.  This would reduce or eliminate the fee that they would pay a third-party to provide such service.
The Internet has reduced outdoor prostitution.

Outdoor prostitution is obviously much more visible to the community at large.  Due to this visibility, especially for those countries where prostitution is illegal, law enforcement agencies are obligated to reduce as much as possible this visibility for legal, political or public policy reasons.  In contrast, indoor prostitution does not have the same visibility to the community and law enforcement.  Therefore, law enforcement is not as focused into indoor prostitution.
Generally, outdoor prostitution is concentrated in a small number of city blocks.  This small geographic area allows law enforcement to conduct enforcement at an acceptable cost.  Law enforcement, like any public agency, operates with a limited budget to meet a large number of public needs.  In contrast, indoor prostitution is spread over a larger geographical area and there are a smaller number of escorts in each individual site.  This feature could make the cost of a law enforcement operation to be much higher than the benefit obtained.
Finally, for an escort, outdoor prostitution is also more dangerous since the escort has a limited time to verify the credentials of a potential client.  However, thanks to the Internet, potential customers can find the escort’s services and those customers can be verified by the escort beforehand.  This makes indoor prostitution preferred to outdoor prostitution.

Is prostitution legal in Panama?

One of the questions we had when we were planning on creating our website was to know if prostitution was legal or not in Panama.  We had heard different opinions on the matter: some people said that it was legal, other people said that it was illegal, other said that it was regulated by the government, and a variety of other opinions on the matter.  Since we didn’t know, we figured that the best thing would be to ask a lawyer.  To our surprise, the lawyers also gave us different answers: one said that it was legal, while another said that it was illegal.

Given that the subject was important to us since we did not want to go to jail, we decided to research the topic ourselves.  This article is the result of our research.  We must warn our readers that we are not lawyers and this article does not constitute a legal opinion or anything like that.

Thanks to the Internet, we found Panama’s Penal Code (as a PDF file) at the OAS (Organization of American States) website.  Please note that the document is written in Spanish since it is the official language in Panama, and there is no english translation of the document  that we found.  Reading the Penal Code, we focused on Title III that deals with crimes against sexual freedom and integrity.  It has three chapters and 19 articles (articles 174 to 192).  Chapter 1 is tittled “Rape and other sexual crimes” has five articles (from 174 to 178) focuses rape, sexual acts without consent, and sexual harassment.  Chapter 2 is tittled “Corruption of Minors, Sexual Exploitation, and other behaviors” contains 13 articles (from 179 to 191) and we will focus on those articles.  Finally, Chapter 3 tittled “Common Provisions” has only one article (number 192) that increases the penalties of articles 174 and 175 in cases of domestic violence.

Returning to Chapter 2, article 179 deals with corruption of people under 18 years old.  Penalties are strong with prison terms anywhere from five to ten years.  For those not familiar with Panama’s prison conditions, let’s just say that  you DEFINITELY want to avoid that.

The article 180 was the one that held most of our interest.  It dealt with those that could profit from sexual exploitation and their corresponding prison terms.

The article 181 indicated the prison terms for those who dealt in the transport of people for sexual servitude and “unauthorized remunerated sexual activity”.

The article 182 indicated the prison terms for those who through threats or violence benefit from those in sexual servitude.

The articles 183, 184, 185, 186, 187, 189 and 190 deals with those people involved in the sexual exploitation of minors and child pornography (making, having, showing, etc.)

The article 188 shows penalties for those that show or provide access to pornographic materials to minors or disabled individuals.

Finally, the article 191 shows penalties for the property owner, the tenant or the administrator of a business or establishment used to commit those crimes indicated in this chapter.

Based on what we read, it seems that prostitution (defined as “the act of engaging in sexual act with other people in exchange for money”) is not listed as a crime in the Penal Code.  Therefore, it is not illegal nor is it a crime in Panama.  What is clearly defined as a crime is sexual exploitation (forcing someone into prostitution) and everything related to minors.  We must remind our readers that this article represents our understanding of the matter and it is not intended as legal advice or anything like that.
